Justices kagan and breyer joined the chief justice did not join her decision nor did she join his dissent. she was making it very clear that not only has the court allowed a law that flagrantly violates existing constitutional precedence it did so under the cover of the shadow docket. we didn't really talk about this as a particular threat to abortion rights in the lead up in part because this case came up on the shadow docket. it wasn't on the merits docket. there wasn't a lot of anticipation. there wasn't full briefing or oral argument or a chance to ventilate all of the different arguments ...
