MUMBAI: While not disqualifying any legislator from the rival factions of the Shiv Sena led by CM Eknath Shinde and Uddhav Thackeray, Maharashtra Asse.
Responding to the serious allegations of "match fixing", raised by Shiv Sena (UBT) faction leader Sanjay Raut ahead of the verdict in the Shiv Sena MLA disqualification case, Chief Minister Eknath Shinde said that the decision to be announced later in the day by Assembly Speaker will have to be made on merit.
He questioned the decision of the Speaker saying that it was strange that none of the MLAs were disqualified. He added, "The Speaker has gone into something that was not his domain by going into the party constitution. They should have stayed within the parameters laid down by the Supreme Court. Today's ruling has insulted the top court."
The Speaker, however, also dismissed the Shinde faction's attempt to disqualify the 14 MLAs of the UBT faction for not obeying its whip, saying there was no evidence to show that the Shinde faction had served notices to the UBT MLAs. "Though the petition (by Shinde tried to show that the whip was served on respondent (UBT MLAs), the petitioner has failed to prove that the whip was served. There are major inconsistencies in the cross examination of Bharag Gogawale (chief whip of Shinde faction)... Thus the disqualification of UBT members also cannot be accepted," he said.
