Sen. Jon Tester, a Democrat who initially supported a ban of TikTok in Montana, reversed course this week after a lawsuit was filed and insisted the state should not have banned the “silly app" earlier this month.
"Montana has no authority to enact laws advancing what it believes should be the United States' foreign policy," TikTok told Newsweek.
If TikTok decides to break away from its Chinese-owned parent company ByteDance, the bill would be automatically void.
The legislation marks the furthest step yet by a state government to restrict TikTok over perceived security concerns.
