BNSF filed a complaint to compel arbitration in federal court Tuesday regarding instances in which the company was named in lawsuits related to a deadly Amtrak train derailment in Mendon, Missouri.
The train was traveling at 89 miles per hour when the emergency brake system initiated, and the NTSB previously said the train's speed at impact was 87 miles per hour.
Amtrak and BNSF Railroad are suing the owner of the dump truck the train hit.
12 family members were onboard, including 82-year-old Bihn Phan who was killed.
