Attorneys for Dwayne Brooks did not have access to statements two women gave police who said they saw five men who were not Brooks at the scene of the August 1987 ambush killing of Clinton Arnold in Luke Easter Park, Cuyahoga County Common Pleas Court Judge William McGinty found.
