HAVING gone through the judgment delivered by the Additional District Magistrate of Lahore in the case against Sardar Sardul Singh, we are only confirmed in the view we have already expressed, that it is impossible to think of a more monstrous sentence than what the Magistrate has seen fit to pass in this case. If ever there was a case in which the guilt of an accused person was not established to the satisfaction of the man in the street it was this case. We do not know much about technical sedition, and are painfully aware of the truth of Dicey’s observation that “the legal definition of a seditious libel might easily be so used as to check a good deal of what is ordinarily considered allowable discussion, and would, if rigidly enforced, be consistent with prevailing forms of political agitation.” And from this point of view, we cannot take it upon ourselves to say whether any of the extracts, on the basis of which Sardar Sardul Singh was prosecuted, do or do not ....
