Friday morning in d. c. federal court? anderson, this is a significant hearing. this is the first time that trump s defense attorneys and special counsel prosecutor would appear before judge tanya chutkan. the last hearing was handled by a magistrate judge, and chutkan is the one who is going to handle all of the hearings up until a likely trial. now, on friday, both sides will have the opportunity to make their arguments about what they think the rules should look like in this case for handling, and publicly sharing any sensitive information. prosecutors want broad protections, defense attorneys are seeking something more narrow. protections only for really sensitive information, which they argue would be more in line with what has happened another january 6th cases. judge chutkan is overseeing dozens of cases related to january 6th, she is an experienced judge, and on the bench for about a decade, and it appears, anderson, based on her scheduling orders so far, she is looking to mo ....

Paula reid has more on that. reporter: judge tanya chutkan has scheduled a hearing for friday a arguments from both attorneys for former president trump and the special counsel about the possible rules for exactly how evidence especially sensitive evidence will be handled in this case. the special counsel has been lobbying for a broad protective order to limit the ability the former president has to share sensitive information that is turned over in this case. but trump s lawyers have argued for something more narrow, something that only covers the most sensitive information. they argue that that would be more in line with the protective orders in other january 6 cases. trump lawyers also asked that the hearing be scheduled text week as they have another hearing in the other special counsel investigation down in florida on thursday. but judge chutkan appears based on her scheduling orders so far to be keen to move this along as ....

This was a complex case. and so then she set out a schedule, very detailed, it goes through all the different deadlines of the motions and everything else. it was far more detailed than a lot of trial orders i ve seen in federal cases, and it does lead out to may. does that mean the trial is actually going to go then? maybe, maybe not. i have had plenty of cases where we have, you know, success of five, ten different scheduling orders because this is based on the information that the judge has at the time that she issued it. she doesn t know whether the delays come in to play. and, you know, one of the things they re talking about there is the facility to view the classified materials, if there s a delay in that. if it takes longer to go through some of the motions, if there s any other type of issues. all of that can result in further successive trials, scheduling orders that would move it out. is it your expectation that ....

Three-month increments throughout multiple different scheduling orders. and every time you file a motion. here they re going to file undoubtedly a motion to dismiss. that s going to stop the clock while that s all being litigated. they re going to file a motion to convert the search warrant that will stop the clock again. and once you start to get into late next year, then they can start talking about their schedule. but the thing is all of the grounds that they re talking about with it takes longer because of classified documents, a judge prefers to see that after you actually have some track record. instead of saying we think it s going the take a long time, if you wait a few months and say hey, judge, this thing is taking a long time. this is why we need more time, that s where the judge has a much easier way of saying yes, i agree. let s push it out. on the idea that only two of the attorneys have applied for security cleearances for these documents, i would think this is probabl ....

Want to push this out indefinitely. now, that to me was odd. well, why i, mean, it is kind of surprising. because, essentially, they are saying it s not just that we want the state. it s, we don t even want you to decide when there should be a date. right, see, in federal criminal cases, the judge will set a date, and everybody knows that it s a fake date. because, they have to set the date based on the 70-day clock. and then the parties can consent to pushing it out, but also, that clock slow stops or any number of reasons. anytime you file a motion, that clock stops. so, to at this stage kind of ask for the judge, hey, just throw away the clock, is weird. because, a federal case of this magnitude will take a couple of years, generally. even if it s not about donald trump, even if it s not a politically sensitive case, it will take a couple of years. but, it will get pushed out in increment s. you know, you will push out three years, in three months increments, throughout multiple ....
