The Court observed that whether or not the actual news is defamatory is irrelevant as allegations and accusations themselves have the effect of lowering one's reputation
"Even without conclusion of inquest proceedings under Section 174 CrPC, case can be registered for investigation by lodging of FIR, on receipt of information about commission of cognizable offence," the Court said.
The Court held that the FIR was a classic example of roping in family members of the husband under Section 498A to settle personal scores with the husband.

The prosecution will have to show that the evidence that is sought to be admitted with respect to Section 498-A of the IPC must also relate to the circumstances of the transaction of the death, the Court observed.
