A lawsuit brought by Kent Elastomer Products may force the Ohio Bureau of Workers' Compensation to pay employers who participated in its Group-Retrospective-Rating Program in 2018.
The lawsuit, brought by Kent Elastomer Products, is related to refunds the manufacturer claims it is entitled to for the 2018 policy year as a participant in the Group-Retrospective-Rating program. The Ohio Bureau of Workers' Compensation declined to issue those refunds because it had provided employers a dividend payment equal to 100% of premiums paid in the 2018 policy year, which it did to support companies during the COVID-19 outbreak.
