Umar Khalid was arrested by the Delhi Police in September 2020 for his alleged role in the Delhi riots, his bail was denied by Karkardooma court in March 2022.
'The only credible evidence that has been presented is that he was exercising his constitutional right to speak and to protest, a fundamental prerogative of citizenship in a free society.'
The same bench had, in two hearings, criticised the activist's Amravati speech, calling it "obnoxious, hateful, offensive and prima facie not acceptable".
The court had earlier taken objection to use of certain words and phrases for the Prime Minister and asked Khalid's counsel to explain what he meant by 'inquilab' and 'revolution'.

While hearing the bail appeal filed by Umar Khalid in relation to the Delhi Riots case, the Delhi High Court remarked that it cannot hold a mini-trial to test the veracity of a witness’ statement.
