Malawian millionaire preacher Shepherd Bushiri, wanted by South Africa on fraud charges, was Thursday ordered freed by a court in his native country following his arrest on an international warrant.
A court in the capital Lilongwe instructed the unconditional release of Bushiri and his wife Mary, a day after they turned themselves over to the police.
Chief magistrate Viva Nyimba ruled their arrest illegal on the grounds that the warrant had not been channelled through the relevant ministry, the couple's attorney said.

RUSTENBERG – The Southern African Development Community (SADC) protocol on extradition which the South African government used in a request to Malawi will not be in proceedings against fugitive Shepherd Bushiri and his wife Mary, local media in that country reported.
The charismatic preacher and his wife are wanted in South Africa, from where they fled ahead of trial for fraud and money laundering charges related to an investment scheme valued at about R99 million.
The SADC protocol is not part of the laws of Malawi and therefore irrelevant in the case, news website Malawi24 reported on Wednesday, citing a ruling by magistrate Patrick Chirwa who said he would only rely on the 1972 extradition agreement between Malawi and South Africa.

Court jails Gomani for motor vehicle theft from murder victim Lucy Kadzamira | Malawi Nyasa Times


Lilongwe principal resident magistrate Viva Nyimba on Wednesday sentenced Arafat Gomani, 22,  to seven years imprisonment for stealing a motor vehicle from a deceased Lucy Kadzamira, whom he is also accused of killing.

Gomani was accused that on October 15  2020  at Area 47 in Lilongwe stole a motor vehicle registration Number DZ 4606 , Mazda Demio valued at K2, 500 000  belonging to Kadzamira.
He pleaded not guilty, but state prosecutor Cecilia Zangazanga paraded four  witnesses to testify on the case.
Nyimba said the prosecution proved its case beyond reasonable doubt and convicted Gomani.

The Bushiris have lost their bid to have Magistrate Patrick Chirwa recused from their extradition hearing in Malawi.
The pair is wanted in South Africa in connection with a fraud and money laundering case.
Their lawyer now wants the court to treat the case as a civil proceeding not a criminal one.
The magistrate's court in Lilongwe, Malawi, has dismissed a bid by self-proclaimed prophet Shepherd Bushiri and his wife, Mary Bushiri, for the recusal of the presiding officer in the pair's extradition hearing.
Magistrate Patrick Chirwa said there were no sufficient grounds for a recusal.
This after the defence made an application on behalf of the Bushiris for Chirwa's recusal on Monday afternoon, arguing the case was moved from the previous magistrate, Viva Nyimba, to Chirwa, without alerting them.

Magistrate Patrick Chirwa has refused to recuse himself from the case in which South African government wants Prophet Bushiri and wife, Mary, be extradited back to South Africa.

Bushiri’s lawyer, Wapona Kita, raised two  arguments explaining why magistrate Chirwa should recuse himslef.
Kita said Bushiri and wife first appeared on 19 November 2020, and matter assigned to Viva Nyimba and a ruling was given that they be unconditionally released and they appear for extradition hearing via summons.
He  noted that the state approached the High Court for review, asking that they be remanded in prison. On objection, the state withdrew their application for review.
