I-TEAM: Granite Creek & other nursing homes cited during pandemic receive large federal bonus payments


A spokesperson for ADHS released the following statement to 12 News regarding the citation:
ADHS is following Arizona state law, which sets a limit on civil money penalties at $500 per violation per day. However, ADHS penalties can and do lead to further enhanced enforcement by the U.S. Centers for Medicare and Medicaid Services, which contracts with ADHS to inspect long-term care facilities and has much greater ability under federal law to impose monetary penalties.
“A $500 fine is pennies on the dollar for the nursing home. It’s almost negligible and really it’s laughable, Lee said.
Following Granite Creek s outbreak, the $500 fine was offset in a big way. The facility was given federal bonus payments in September, October, November and December totaling $187,969. ....

Nursing Home-Pharmacy Partnership For COVID-19 Vaccine To End


Pharmacy chains like Walgreens and CVS have been vaccinating long-term care residents and staff since December. Now, that program is coming to an end. 
Both Walgreens and CVS are wrapping up their third and final vaccine clinics in the coming weeks. But where do long-term care facilities go from here? 
Staff turnover is high, and new caregivers will need the vaccine; so will new residents. 
David Voepel is the CEO of the Arizona Health Care Association.
So we re hoping that in the very near future, this turns into [something] like a flu vaccine for us, he said. So that we call our long-term care pharmacist. And we have enough folks to make up a vial of vaccine. ....

A Year After Nursing Homes Shut Down, Visits Are Once Again Allowed

Nearly a year after nursing homes were shut down due to the coronavirus pandemic, the Centers for Medicare and Medicaid updated its guidance on indoor visits.
David Voepel is the CEO of the Arizona Health Care Association. His organization represents the state’s 148 skilled nursing facilities, which are regulated by Centers for Medicare and Medicaid.
“Facilities are now allowed to have responsible indoor visitation at all times and for all residents pretty much regardless of vaccination status of the resident and visitor unless the county positivity rate is greater than 10% and the 70% of the residents are fully vaccinated.” ....

Arizona Bill Would Make It Harder To Sue Nursing Homes

AARP Arizona wants state lawmakers to oppose a bill that would significantly shield long-term care facilities from civil suits related to COVID-19. 
Senate Bill 1377 would shield health care workers and institutions from liability for a COVID-related injury or death as long as they acted in good faith, according to the bill. That is, unless it can be proven by “clear and convincing evidence” that there was a failure to act and the worker or institution acted with willful misconduct or gross negligence. And that can be difficult to prove. 
Dana Kennedy with AARP Arizona says families need a legal course of action if they believe there was wrongdoing, especially when most inspectors were not able go into facilities, and they suspended family visits. And they didn t even allow ombudsmen to go into the facilities, she said. ....
