Reasons for Leave
Massachusetts employers are required to provide emergency paid sick leave to employees who are unable to work for the following COVID-19-related reasons:
an employee’s need to:
self-isolate and care for themself because they have been diagnosed with COVID-19;
get a medical diagnosis, care, or treatment for COVID-19 symptoms; or
get or recover from a COVID-19 immunization;
an employee’s need to care for a family member
1 who:
needs medical diagnosis, care, or treatment for COVID-19 symptoms;
a quarantine order or similar determination regarding the employee by a local, state, or federal public official, a health authority having jurisdiction, or a health care provider; ....

While California has announced tentative plans to lift COVID-19 restrictions by June 15, 2021, the difficulties for employers are not over.
For much of the COVID-19 pandemic, California struggled to get infection rates under control, and businesses grappled with compliance with a multitude of COVID-19-specific statutes and regulations. Employers also were tasked with navigating existing California employment laws, which did not contemplate a worldwide pandemic.

Oakland Extends its Emergency Paid Sick Leave Ordinance

Joining other counties and cities in California, the City of Oakland voted to extend its Emergency Paid Sick Leave ordinance into 2021. The amended ordinance applies retroactively to December 31, 2020, and will remain in effect until the City’s Declaration of COVID-19 Emergency expires.
The amended ordinance applies to all employers that have employees working in the City of Oakland, with the exception of certain smaller employers that are exempt from the ordinance’s requirements.
No Additional Time
Like the original ordinance, the amended ordinance provides full-time employees with 80 hours of Emergency Paid Sick leave (part-time employees receive a pro-rata amount). However, the amended ordinance states that employers are only required to provide Emergency Paid Sick leave on a one-time basis.
