Federal Court rules political parties cannot sue individuals for defamation

PUTRAJAYA (Bernama): The Federal Court has ruled on Thursday (March 4) that political parties cannot sue individuals for defamation.
Court of Appeal President Tan Sri Rohana Yusuf, who chaired a seven-member bench, said the court had answered in the negative to a legal question posed by Kepong MP Lim Lip Eng to strike out a defamation lawsuit filed against him by MCA,
The question was whether a political party could maintain a suit for defamation in the light of the decision in Goldsmith v Bhoyrul (1998), an English case which provided that political parties cannot be claimants in defamation suits.
In allowing the appeal by Lim, Justice Rohana, set aside the decisions of the High Court and Court of Appeal which dismissed Lim s application to strike out the suit. ....

An apology and cash payment has been made by a public relations consultant to three public health experts who were victims of defamatory online attacks alleged to have been funded by money from Big Sugar and Big Tobacco.
The apology from Carrick Graham came in the opening hours of a defamation case at the High Court in Auckland in which evidence was to be produced showing he had taken money from clients in alcohol and food industries and paid former Whale Oil blogger Cameron Slater to attack public health researchers. ....

A former Chief Security Adviser to Governor Godwin Obaseki of Edo State, Mr. Haruna Abiona, has demanded N3.6bn from the Edo State Caretaker Committee Chairman of the All Progressive Congress, Col. David Imuse, (retd.), and three others for defamation of character.
Haruna, in a letter endorsed by his counsel, Ainabeholo Oseikhuemen, asked the APC chieftains, including Tony Kabaka Adun, Emperor Jarret Tenebe, State Deputy Chairman, Edo North and Adams Shaba, President, Professional Drivers on Wheels, to tender an apology and retract defamatory statements and publications against him within 14 days. ....
