Malema unhappy with Concourt's delay in delivering state capture inquiry vs Zuma ruling

Malema unhappy with Concourt’s delay in delivering state capture inquiry vs Zuma ruling

EFF leader Julius Malema has expressed his concerns about the Constitutional Court’s delay in delivering its ruling in the matter between state capture inquiry and former president Jacob Zuma.
Malema, addressing the media in Johannesburg on Thursday, told journalists he had a problem with the time it has taken the apex court to deliver its ruling in the commission of inquiry into state capture’s bid to have Zuma jailed for two years for snubbing subpoenas to give evidence.
“The only problem I have is with the Constitutional Court, (commission chairperson Deputy Chief Justice Raymond) Zondo ran and went to the Constitutional Court and said he has an urgent application on Zuma’s appearance before the commission. It was an urgent application until today it has not given its pronouncement on an urgent application,” Malema said.

JUST IN | Casac takes JSC to court for its 'unconstitutional' interviews of ConCourt justice nominees

The Judicial Service Commission's shortlisting of Constitutional Court justices – during which JSC commissioner, Julius Malema, attacked Judge Dhaya Pillay for her friendship with Pravin Gordhan – is now being challenged in court.
The Council for the Advancement of the SA Constitution (Casac) on Thursday filed papers at the Johannesburg High Court, in which it challenges the constitutionality of those interviews, which saw Chief Justice Mogoeng Mogoeng actively politicising Pillay's interview – after Malema accused her of being an "activist judge", and said she was "unfit for office" because of her friendship with Gordhan.
In the closing moments of Pillay's interview, Mogoeng suddenly remembered that then finance minister Gordhan had, during an unrelated meeting, asked him how she had done in her 2016 interview for a position at the Supreme Court of Appeal.

EFF leader Julius Malema has responded to the members of the KwaZulu-Natal Society of Advocates who, in their personal capacities, slammed the treatment of two judges at the recent Judicial Services Commission (JSC) interviews.
On Thursday, Malema responded to the complaint, saying, “They can voetsek”.

82 members of the society lambasted the treatment judges Dhaya Pillay and Piet Koen received during their interviews last month, saying it was in an “unfortunate manner”.
“Overall this statement is advanced out of a concern that on account of the JSC interviews, the public may perceive that the two judges are somehow not worthy of their judicial positions,” said the members.

The Judicial Service Commission (JSC) announced on Wednesday that it recommended Supreme Court of Appeal justices Mahube Molemela, Rammaka Mathopo and Gauteng High Court judges Fayeeza Kathree-Setiloane, Jody Kollapen and Bashier Vally for appointment as justices to the Constitutional Court.
The candidates were selected from eight interviewed on Monday and Tuesday. President Cyril Ramaphosa will choose two from the list.
The candidates who did not get the nod were judges Dhaya Pillay, from the KwaZulu-Natal high court division, and David Unterhalter from the Gauteng division, as well as senior counsel Alan Dodson.

THE Judicial Service Commission's (JSC) interviews to fill vacant posts at the country's top courts have seen some candidates asked about whether the Constitution allowed for the expropriation of land without compensation.
The JSC kicked off interviews to fill two vacancies at the Constitutional Court on Monday.
By Wednesday it had began conducting the interviews for five vacancies at the Supreme Court of Appeal.
Judge Zeenat Carelse, who was appointed to the South Gauteng High Court in Johannesburg Court in 2009, faced questions from commissioners about the land issue boggling the country. She currently serves as an acting judge at the SCA until May.
