Supreme Court (SC) Associate Justice Edgardo L. Delos Santos is set to retire on Wednesday, June 30, a year earlier than his mandatory retirement at age 70 on June 12, 2022.
The SC, as a full court, had approved Delos Santos’ early retirement “for reasons pertaining to his current state of health.” His “state of health” was not disclosed.
With the retirement of Delos Santos, who was appointed by President Duterte in Dec. 2019, there are now two vacancies in the 15-member SC.
The first vacancy was a result of the promotion of then Associate Justice Alexander G. Gesmundo as Chief Justice last April 5. ....

The House of Representatives Electoral Tribunal has junked the electoral protest filed against the progressive Kabataan Partylist, represented in the Lower House by Rep. Sarah Jane Elago.
In a resolution penned by Supreme Court Associate Justice Rosemari Carandang, the HRET, composed of three SC justices and five congressmen, dismissed the election protest filed by the You Against Corruption and Poverty (YACAP) through its chairperson and first nominee, former Rep. Carol Jayne Lopez.
Lopez assailed the alleged presence of “electoral fraud, anomalies and irregularities” that altered the true results of the partylist race during the mid-term elections in 2019. ....

JBC opens application, recommendation to SC associate justice post

The Judicial and Bar Council (JBC) has opened the application or recommendation to the Supreme Court (SC) associate justice post that was vacated with the promotion of Associate Justice Alexander G. Gesmundo as Chief Justice and head of the judiciary last April 5.
In an announcement, the JBC said applications or recommendations must be received not later than May 10.
It said applicants and those recommended must submit the complete and accurate digitized version of all documentary requirements to [email protected].
The JBC is the constitutional body that accepts, screens, and nominates appointments to the judiciary.
There may be another vacancy in the 15-member SC if the High Court approves the retirement sought by Associate Justice Edgardo L. Delos Santos who had signified his intention to retire early on health reasons. ....

Gesmundo will serve as the country’s 27th Chief Justice of the Supreme Court, taking the place of Diosdado Peralta who retired early last month. He first secured a seat in the High Tribunal as Associate Justice in August 2017.
“The Palace confirms the President has signed the appointment of former Associate Justice Alexander Gesmundo as new Chief Justice of Supreme Court,” Presidential spokesman Harry Roque said in Filipino during a televised press briefing Monday.
Roque noted Gesmundo was not new in the judiciary, citing his years of service as Associate Justice in the Supreme Court as well as Associate Justice in the Sandiganbayan. ....
