IHC suspends removal orders fro NBP president, chairman

Accepting the intra-court appeal of the government and National Bank of Pakistan on Thursday, a division bench of the Islamabad High Court (IHC) suspended a single-member bench decision that set aside appointment notifications of National Bank of Pakistan President Arif Usmani and NBP board of directors Chairman Muhammad Zubyr Soomro. A single-member bench of the IHC comprising Justice Mohsin Akhtar Kiyani had declared both the appointment notifications illegal on June 28. Federal finance ministry and National Bank of Pakistan challenged the verdict while filing Intra Court Appeal against the decision claiming that no irregularity had been committed while issuing the notifications for filling the slots. Syed Jahangir, Javed Iqbal, Fazal Raheem, and Latif Qureshi have challenged the appointments while assailing the government’s notifications of 2019 in the matter. There is a growing debate that the discretionary powers of the Chief Justice of Pakistan should be structured and regulated to ensure more transparency in the affairs of the Supreme Court. The CJP currently enjoys unfettered discretionary powers to constitute benches, ‘fix’ cases and initiate public interest proceedings under Article 184 (3) of the constitution. Likewise, being Chairman Judicial Commission of Pakistan (JCP) as well as Supreme Judicial Council, the CJP has vast discretionary of the powers in the process regarding judges appointments and their removal under Article 209 of constitution. ....

ISLAMABAD: The Islamabad High Court (IHC) on Monday disposed of an Intra Court Appeal (ICA), challenging the qualification of Federal Minister for Water Resources Muhammad Faisal Vawda after the petitioner decided to withdraw the case. Chief Justice Athar Minallah remarked that this case was non-maintainable and the bench was going to dismiss it. The chief justice asked the petitioner that whether he was ready to withdraw the case as he had also alternate forums. At this, the petitioner s lawyer expressed willingness to withdraw ICA. ....

After Justice Yahya Afridi, another apex court judge – Justice Qazi Faez Isa – has raised questions about the discretionary powers exercised by the Chief Justice of Pakistan (CJP) – a position currently held by Justice Gulzar Ahmed.
The CJP currently enjoys unfettered discretionary powers to constitute benches, “fix” cases and initiate public interest proceedings under Article 184 (3) of the Constitution.
Building a case against “unstructured discretion”, Justice Isa – in a letter written to Justice Gulzar Ahmed on February 10 – noted that the Supreme Court often castigates arbitrary exercise of discretion, yet while making benches hearing important constitutional matters unstructured discretion is exercised. ....

ISLAMABAD (Dunya News) - Prime Minister Imran Khan has taken stern notice of the traffic accident that took place in Islamabad Monday night and has sought complete details from the authorities.
The Prime Minister directed the Ministers to not use government resources unnecessarily in the name of security. He also sought a report on how much security do the ministers have.
He said that the Parliament is a representative forum of the whole nation, where every minister is accountable. If Democracy is to strengthen, the Parliament itself must be strengthened, he added. ....
