In an interim rule published on, January 15, 2020, the Department of Commerce, Bureau of Industry and Security (BIS), introduced expansive changes to General Prohibition 7 of the Export Administration Regulations (EAR) by including new controls on military-intelligence end uses and users, making the already tricky process of conducting business with foreign entities that much more complicated.
After minor corrections, a rule that many missed or ignored goes into effect on March 16, 2021. The rule will impact US companies and persons, as it affects the activities of US persons – even if the US person is not dealing with an item that is not subject to US export control laws! ....

On 15 January 2021, the Bureau of Industry and Security (BIS) published an interim final rule imposing new restrictions requiring licenses for transactions involving exports, reexports, or transfers, as well as certain transactions by U.S. persons, involving “military-intelligence end uses” or “military-intelligence end users” in China, Russia, Venezuela, or a country listed in Country Group E:1 or E:2.

Key Points
The U.S. government has recently imposed controls pertaining to “Communist Chinese Military Companies” (CCMCs or “1237 entities”); Chinese “Military End Users” (MEUs); and Chinese “Military-Intelligence End Users” (MIEUs). The U.S. government has also been adding Chinese companies to the Entity List based on concerns regarding the companies’ relationships to the Chinese military industrial complex.
Although the names and underlying policy concerns are similar, the scope and source of the prohibitions regarding each set of Chinese entities are quite different. Companies on one of the lists are not automatically on others, but overlap is possible as the lists evolve. These lists are in addition to the Chinese entities that are on the Unverified List (UVLs), the Denied Persons List (DPLs), and the Specially Designated Nationals and Blocked Persons List (SDNs). ....
