Appeals court upholds COVID-19 delays in criminal trials

In a partial rebuke of a lower court jurist, a federal appeals court decided Friday that criminal defendants were not robbed of their right to speedy trials or forced unconstitutionally to remain behind bars because the COVID-19 pandemic delayed their trials.
“Surely a global pandemic that has claimed more than half a million lives in this country, and nearly 60,000 in California alone, falls within such unique circumstances to permit a court to temporarily suspend jury trials in the interest of public health,” said a three-judge panel of the U.S. 9th Circuit Court of Appeals.
The appeals court ruling effectively affirms that COVID-19 was an emergency that forced some courts to take unprecedented steps, including delaying proceedings. It means that criminal defendants are unlikely to prevail in claiming they should escape charges or get out of jail because of pandemic-induced delays. ....

Quivey Named Acting U.S. Attorney for Central District

The Central District Court of Illinois has a new head attorney.
The U.S. Department of Justice announced today that Douglas J. Quivey will take over for the departed John Milhiser in the U.S. Central District Court of Illinois. 
Quivey a Charleston native and current Springfield resident has served as the First Assistant U.S. Attorney for the district since 2019. He also held the position of Assistant Federal Public Defender in the Central District of Illinois from October 2014 to December 2018.
In 2018, Quivey retired from the U.S. Army and Army Reserves as a Lieutenant Colonel. Quivey was in private practice from 1996 to 2014 in Charleston, Urbana, and Springfield. ....

Solomon Lew-backed Breville bagged over alleged patent poach

The US group behind an increasingly popular sous vide cooking appliance is suing Solomon Lew-backed appliance retailer Breville, alleging it breached an agreement between the two companies known as “Operation Hotwater”.
The legal stoush comes as Breville posted a bumper $64.2 million profit for the first six months of the financial year, boosted by a surge in demand for its various coffee makers, blenders and juicers from locked-down shoppers across the world.
Breville is being sued over an alleged breach of contract relating to a popular sous vide product line.
Illinois-based Preston Industries’ sous vide product line was acquired by Breville in 2014, with Breville agreeing to pay Preston a licensing fee to sell the appliances. Under the terms of the agreement, Breville also agreed to purchase models from Preston as the circulators were updated. ....

Rose Ochi, trailblazer for civil rights and Japanese American causes, dies at 81 [Los Angeles Times]
Rose Matsui Ochi, a trailblazing Los Angeles attorney who tapped far-flung political networks from City Hall to Congress in her fierce advocacy of civil rights, criminal justice reform and Japanese American causes, has died at 81.
Ochi died Dec. 13 at a local hospital after being diagnosed with a second bout of COVID-19, which exacerbated existing health problems, her husband, Thomas Ochi, said.
Ochi broke barriers as the first Asian American woman to serve as a Los Angeles Police Commission member and as an assistant U.S. attorney general. She advised L.A. Mayors Tom Bradley and James Hahn on criminal justice, served on President Carter’sSelect Commission on Immigration and Refugee Policy and worked with President Clinton on drug policy and race relations. ....
