据中国裁判文书网官网披露的一则民事判决书显示，俞某于2009年2月1日入职XXX公司，
2017年3月31日、4月24日、5月23日俞某因腰椎疾病先后至上海市黄浦区XX医院就诊，并经医院开具了建议休假期分别为2017年3月31日至2017年4月1日、2017年4月24日至2017年5月6日、2017年5月23日至2017年6月6日的三张“病假证明”，其中建议休假期为2017年5月23日至2017年6月6日的“病假证明”开具人为上海市黄浦区XX医院伤科医师卢某，2017年5月23日的医疗门（急）诊收费票据还显示开出的中成药包括石氏益肾健腰合剂、珍宝丸。
2017年5月24日俞某向公司发送电子邮件，申请2017年5月23日至2017年6月3日休病假，并以电子邮件附件形式向公司提交了建议休假期为2017年5月23日至2017年6月6日的“病假证明”，公司对俞某的上述病假申请予以批准。
2017年5月26日俞某凭2017年5月11日签发的旅游签证自上海浦东出境前往德国，并于2017年6月4日入境回国。
在管理人员一再追问情况下称“没怎么玩，只是去外面休息一下而已。”
同时，俞某收到公司出具的“解除通知”，内容为：“……然而，在您申请的上述病假期间，您虽停工但事实上并未在家休养！您利用编造虚假病情和人情关系换来的医院病假证明，骗取公司病假的欺诈行为是违背公司与您之间相互信赖建立长期劳动关系的基础原则的。这种严重失信的行为也与我国法律法规的基本原则所抵触的。鉴于您的上述行为也事实上造成您连续旷工满三日，依照公司员工手册第五章第三条第二款第三项的规定，亦应当单方面解除与您的劳动合同。特此，公司正式告知，您与公司之间的劳动关系依法解除，即日生效。请立刻与公司办理离职与交接手续”。
2017年6月29日俞某提起仲裁申请，要求公司撤销解除决定，自2017年6月7日起恢复双方劳动关系，继续履行劳动合同。仲裁委员会作出裁决,对俞某的请求不予支持。
俞某不服该裁决，遂诉至一审法院。
本案中，俞某于2017年5月23日前往医院就诊，2017年5月24日就以腰椎疾病为由向公司申请2017年5月23日至2017年6月3日的病假，2017年5月26日即出境前往德国。2017年6月4日入境返回中国。
在2017年6月7日公司委托的相关人员与俞某的谈话中，俞某先是称其2017年5月23日至2017年6月3日期间系在家休养，后在公司人员再次追问并表明已至医院调查后又承认去外面休息了，结合一审法院查明的俞某曾于2017年5月26日出境至德国及2017年6月4日回国之事实。
二则根据一审法院至上海市黄浦区XX医院中医骨伤科卢某处的调查情况，卢某称俞某至其处就诊时并未提供CT检查报告等材料，故卢某系根据俞某口述的腰痛病情而怀疑俞某患有腰椎间盘突出症，并以俞某就诊时自述的腰椎病情程度依然无法胜任工作之情况为俞某开具了“病假证明”，由于卢某明确表示2017年5月23日对俞某病情的诊断意见仅为怀疑其患有腰椎间盘突出症，故在俞某病情尚未确诊的情况下顶格为俞某开具全休14天的“病假证明”（建议休假期为2017年5月23日至2017年6月6日），公司有理由质疑俞某可能存在骗取病假的不诚信行为。
综上，公司以俞某违背诚实信用原则，严重违反公司规章制度为由决定解除与俞某的劳动合同合法有效。
