A step in the right direction on private prosecutions

The current system for funding of private prosecutions is unfair. The Justice Committee concluded as much when we produced our report,
Private prosecutions: safeguardslast October. And the government agrees with that conclusion in the response we are publishing today, as well as pledging changes to the way that private prosecutions are funded.

I am delighted that the government has decided to support one of our recommendations and, crucially, has given a commitment to legislate.
Our inquiry into private prosecutions was prompted by the Criminal Cases Review Commission. The Commission wrote to us after it had referred a record number of convictions, all stemming from prosecutions brought by the Post Office, to the courts. We examined how private prosecutions were working in England and Wales. Overall, we concluded that private prosecutions play an important role and that the existing safeguards general ....

Defendant with Covid symptoms unable to call court

A defendant turned up to court to explain he had Covid symptoms because he could not get through to staff on the phone, a solicitor-advocate has told MPs to highlight the pressures arising from how the justice system is coping during the pandemic.
Giving evidence on court capacity to the Commons justice select committee on Tuesday, Hollie Collinge, of Brighton firm Kellys Solicitors, said: ‘I’ve noticed enormous uncertainty and anxiety about whether people should or shouldn’t be going to court. Panel will 'test and challenge' criminal legal aid recommendations

The Ministry of Justice has named a wide-ranging panel of legal experts - including a former co-chair of the Law Society’s criminal law committee - to test and challenge the recommendations made by the independent review into criminal legal aid.
The review, looking at the system in its entirety, is being led by competition lawyer and former judge
Sir Christopher Bellamy. The Ministry of Justice said the panel,
The panel includes: Tuckers managing partner Richard Atkinson, immediate past co-chair of the Society’s criminal law committee; Bill Waddington, former chair of the Criminal Law Solicitors Association; solicitor and deputy High Court judge Margaret Obi, a former member of the Society s criminal law committee; Crispin Passmore, a former director at the Solicitors Regulation Authority; and Dr Natalie Byrom, director of research at the Legal Education Foundation. ....

Expert and Advisory Panel appointed for Independent Review of Criminal Legal Aid


Sir Christopher Bellamy QC (Chair):
Sir Christopher is a former judge with a wealth of legal experience. He has recently stepped down as Chairman of Linklaters global competition practice and joined Monckton Chambers to focus on mediation and arbitration. Sir Christopher will lead a dedicated review team within Government and will have close oversight of the work to ensure it meets these terms of reference and delivers robust, evidence-based recommendations.
Professor Sue Arrowsmith QC:
Sue Arrowsmith is Professor Emerita of Law at the University of Nottingham, where she was formerly Director of the Public Procurement Research Group and leader of the EU Asia Link project to establish procurement research centres globally. She was appointed Queen’s Counsel (honoris causa) in 2019 and in 2007 received the CIPS Swinbank Medal for thought innovation in purchasing and supply.
