A five-judge Constitution Bench of the Supreme Court on Wednesday unanimously declared a Maharashtra law that provides reservation benefits to the Maratha community, taking the quota limit in the State above 50 per cent unconstitutional.
The Bench led by Justice Ashok Bhushan found no “exceptional circumstances” or “extraordinary situation” in Maharashtra, which required the Maharashtra government to break the 50% ceiling limit to bestow quota benefits on the Maratha community.
The Supreme Court struck down the findings of Justice N.G. Gaikwad Commission which led to the enactment of the Maratha quota law and set aside the Bombay High Court judgment, which validated the Maharashtra State Reservation for Socially and Educationally Backward Classes (SEBC ....

Bench asked other States too to make their stand clear on 50% boundary in quota
The Supreme Court on Wednesday will pronounce its judgment on the constitutional validity of the Maratha reservation law which leads to quota in the State in excess of the 50% ceiling limit.
The Constitution Bench is led by Justice Ashok Bhushan and comprises Justices L. Nageswara Rao, S. Abdul Nazeer, Hemant Gupta and S. Ravindra Bhat.
The Bench had also examined whether its nearly three-decade-old judgment in the Indira Sawhney case, which fixed reservation for the marginalised and the poor in government jobs and educational institutions at 50%, needs a re-look. ....

Maratha quota: SC to resume hearing pleas challenging SEBC Act today 
Mumbai: A constitution bench of the Supreme Court will on Monday recommence the day-to-day hearing in the matter challenging the Maharashtra State Reservation for Socially and Educationally Backward Classes Act for providing educational and employment reservation to the Marathas.
The top court will also examine whether Indra Sawhney s judgment could be referred to a larger bench in view of the subsequent constitutional amendments and the socio-economic changes that have followed. ....
