Pa. lawsuits against restaurants continue after COVID-19 restrictions loosen; 6 Lancaster County restaurants named


During nearly a year of restrictions on restaurants meant to limit the spread of COVID-19, Gov. Tom Wolf’s shutdown of dining rooms during the normally busy winter holidays was especially tough for restaurant owners.
Some ignored the rules, keeping their dining rooms open during the three-week period that ended Jan. 5. In response, enforcement was stepped up as the Wolf administration started issuing “closed by order” notices on the spot to restaurants found to be in violation, a first during the pandemic.
As part of the Wolf administration’s toughened enforcement, 50 restaurants – including seven from Lancaster County – that got closure notices then stayed open found themselves on the receiving end of a pair of lawsuits from the state Department of Health that sought some intimidating remedies. ....

6 Lancaster County restaurants sued by state Dept. of Health for violating Gov. Wolf's indoor dining ban


But the Jan. 5 suit adds a provision seeking damages and restitution for “unjust enrichment” by the restaurants, including “wrongful gains and disgorgement of profits realized through their violations of the order.”
The Lancaster County restaurants named in the new suit all received “closure by notice” orders between Dec. 21 and Dec. 27 from the state Department of Agriculture for violating the indoor dining ban.
The Lancaster County restaurants named in the Jan. 5 department of health suit are:
Brickerville Family Restaurant, 2 28th East Division Highway, Lititz.
Hometown Kitchen, 18 Furnace Road, Quarryville.
New Holland Coffee Company, 832 West Main St., New Holland.

7 more Lancaster County restaurants got closure notices for defying Gov. Wolf's just-expired indoor dining ban


Six Lancaster County restaurants were among 36 businesses the state ordered to close for defying COVID-19 restrictions during Gov. Tom Wolf’s indoor dining ban which ended Monday. One closure notice was issued by Lancaster city, which conducts its own inspections. 
The “closed by notice” orders from the state Department of Agriculture were issued for the week ending Jan. 3, the day before the temporary order banning indoor dining expired. With six restaurants ordered to close, Lancaster County was tied with York County for the most in the state last week. 
The department handles inspection of most restaurants in the state outside of major cities. Lancaster city, which conducts its own restaurants inspections, issued a closure notice last week to Café One Eight, 18 W. Orange St., which was forwarded to the agriculture department.   ....

On Monday, Lancaster County restaurants will once again be allowed to offer some indoor dining, ending a three-week ban meant to slow the spread of COVID-19.
But instead of shutting down during the normally busy holiday season, some restaurant owners defied Gov. Tom Wolf’s three-week ban, opening their dining rooms up for customers, and themselves up to possible state sanction.
And long after dining rooms are legally allowed to be open, problems could persist for owners who violated the latest order, as they did for some who held out against mitigation efforts in the spring, and then fought extended battles in court. ....

Manheim Township's Olde Hickory Grille among 40 restaurants statewide ordered closed for defying indoor dining ban


One Lancaster County restaurant was among 40 businesses across the state recently ordered to close for defying Gov. Tom Wolf’s ban on indoor dining until Jan. 4.
Olde Hickory Grill in Manheim Township was “closed by order” on Dec. 16 as the state began enforcing the new restrictions on restaurants that went into effect Dec. 12.
However, the restaurant at 709 Olde Hickory Road was still operating this week. An employee who answered the phone Wednesday afternoon confirmed customers were still being served inside, adding that she hadn t heard anything about a closure order.
Neither a manager nor an owner were available to comment, the employee said. ....
