Nursing Home Company Sued for Unsolicited Fax Ads

In a Northern District of Ohio case filed on Thursday, Family Health Physical Medicine LLC alleged that it had received a fax soliciting nursing home operator Brookdale Senior Living’s services. The fax purportedly included an invitation for recipients to “to tour the facility ‘to meet our staff’, ‘learn more about how we will serve your clients,’ and offered ‘a complimentary pizza to-go’ to entice the recipients to accept the invitation.”
The complaint alleged that the fax was unaddressed and designed to be sent to medical providers such as Family Health to generate referrals. As such, the complaint is a putative class action, being brought on behalf of “All persons who (1) on or after four years prior to the filing of this action; (2) were sent the Brookdale Fax or similar material; (3) via facsimile; (4) and for whom Brookdale Senior Living has no documents purporting to show the intended recipient� ....

Class Action Alleges Select Medical Corporation Violated TCPA Through Unsolicited Faxes

Family Health Physical Medicine LLC (FHPM) is leading a class action in the Northern District of Ohio against Select Medical Corporation (SMC) over allegations that the defendant sent an unsolicited fax advertising its services to the plaintiff.
SMC is a provider of physical therapy services under the trade name NovaCare Rehabilitation. According to FHPM, it received a fax advertising NovaCare’s services on Aug. 22, 2019. The fax was not addressed to anyone, FHPM said, and the plaintiff claimed its purpose was to target medical professionals who may refer patients to NovaCare.
“The NovaCare Fax offered to ‘better serve you and your patients,’ ” the complaint said, “invited the intended recipients to ‘make a referral,’ and promised to ‘contact your patient and schedule them within 24 hours.’ ” ....

Joe Tait joins Family Health Physical Medicine in Alliance

Chiropractor Joe Tait recently joined the Family Health Physical Medicine team in Alliance.
Tait completed his bachelor of arts in exercise science from the University of Akron. He earned his doctorate in chiropractic in 2019 at Life University in Marietta, Georgia.
Tait specializes in diversified/full spine, activator, Thompson, SOT and Toggle.
“I’m excited to begin my career here in Alliance and look forward to serving the good people of this town,” Tait said in a news release.
Tait and his wife, Danielle, have two children. He s an avid Buckeyes, Browns and Indians fan.
Family Health Physical Medicine is offering extended hours for new and existing patients. Hours are 8 a.m. to 6 p.m. Monday through Thursday; 8 a.m. to 5 p.m. Friday; and 8 a.m. to 2 p.m. Saturday. Call (330) 821-4455 to schedule an appointment. ....
