Majority of 2011 paper co-authored by criminal law committee member is plagiarised

Several sections of a paper co-authored by Balraj Chauhan a member of the home ministry’s Committee for Reforms in Criminal Laws are plagiarised. The paper, titled “Good Governance: Search for Accountability Mechanism,” was published in the Indian Journal of Public Administration in October 2011.
Chauhan was the vice chancellor of Dharmashastra National Law University in Madhya Pradesh’s Jabalpur until mid-June this year. Chauhan’s co-author, Mridul Srivastava, is an assistant registrar at the Dr Ram Manohar Lohiya National Law University in Lucknow. The IJPA is a peer-reviewed journal of the Indian Institute of Public Administration, which describes itself as an autonomous academic institution. Chauhan and Srivastava’s paper is a little over 4,500 words long. Of these, at least 3,500 words had previously appeared in other publications, written by other authors, and only about a little over nine hundred words appear to be original. ....

On May 4, 2020, The Ministry of Home Affairs (MHA) constituted a national-level committee to recommend criminal law reforms in India. Among other issues, the Committee will be looking into issues relating to “hate speech”. A number of people have been accused of making hate speeches, yet very little is understood about what actually is hate speech. In the recent Delhi riot case, the police made selective arrests of people held responsible for making hate speeches. Proposed hate speech provisions should be clear and free of vagueness
Speech is free, but it is a freedom that comes with responsibility. And responsible speech is not just something that does not contain abuse, defamation or incitement to violence. It is increasingly seen as expression that tends not to discriminate against or incite hatred towards groups based on race, gender, caste, religious belief, sexual orientation, nationality or immigration status. The world has moved away from a free speech doctrine based on a formal equality among different viewpoints to one that discourages the targeting of any vulnerable section. The term ‘hate speech’ and calls for laws that specifically seek to punish it arise from this inclusive understanding of the basis on which speech is restricted in modern democracies.
