Children of Tanya Day receive human rights award


The children of Yorta Yorta woman Tanya Day have received the 2021 Voltaire Human Rights Award on Thursday - for their sustained activism for justice for First Nations people. 
Ms Day was arrested for public intoxication in December 2017, and was held in a cell at the Castlemaine Police Station before she died in hospital.
Since her death, her four children, Apryl, Belinda, Warren and Kimberly Watson were instrumental in pushing to change public drunkenness laws, with the offence decriminalised in February.

Three years after the death of Yorta Yorta woman, Tanya Day, who was arrested for public drunkenness and suffered a fatal fall in a police cell at Castlemaine Police Station, Victoria has finally passed legislation to decriminalise public drunkenness.
Decriminalising public drunkenness was in fact, one of the recommendations of the Royal Commission into Indigenous Deaths in Custody 30 years ago.
A health issue, not a crime
Despite the fact that this is seen as an important step towards justice for Indigenous Australians, there are still calls for the Victorian Government to consider wider reform including an agenda which brings greater accountability to policing. ....

Tanya Day's family to sue Victorian Government over Yorta Yorta woman's death in custody


The family of Tanya Day, who died in custody in 2017, is suing the Victorian Government for false imprisonment and wrongfully causing the Yorta Yorta woman s death.
Ms Day was arrested for public drunkenness after falling asleep on a train. She was taken to Castlemaine Police Station where she hit her head multiple times.
She died in hospital 17 days later.
A lawsuit filed in the Supreme Court alleges that Ms Day s arrest was unconstitutional because public drunkenness laws are disproportionately applied to Indigenous people in Victoria, and are in violation of human rights conventions and the Victorian Charter of Human Rights. ....

The family of Yorta Yorta woman Tanya Day, who died in 2017 from injuries sustained in a country Victoria police station say they are ‘devastated’ that two police officers on duty on the day of the incident have escaped serious disciplinary action.
Victoria Police have confirmed there had been no serious sanctions against Sergeant Edwina Neale or Leading Senior Constable Danny Wolters, the two officers referred by Deputy State Coroner Caitlin English for potential criminal charges over the high profile death in custody. ....
