Federal anti-corruption body won't be operational before next election, budget papers reveal | Australian budget 2021


The 2020 budget listed the CIC’s average staffing level as 76 in the current financial year.
The draft CIC legislation is out for consultationand has been roundly criticised for its lack of public hearings, favourable treatment of public officials and politicians, and inability to act directly on public tip-offs.
The budget papers note that the CIC legislation is yet to be passed through parliament and appear to suggest it is still the government’s intention to legislate.
But the development has prompted concerns from both the Centre for Public Integrity and the Australia Institute, who say it shows the CIC will not be operational prior to the next election. ....

The Morrison government’s top investigator of misconduct by public officials has backed the establishment of a Commonwealth Integrity Commission with strong powers of surveillance.
Dr Vivienne Thom has been involved in investigating serious alleged misconduct across the public service, including at the High Court, the corporate watchdog and the Department of Infrastructure.
Inquisitor-in-chief Dr Vivienne Thom says a Commonwealth Integrity Commission is needed.

Dr Thom said an integrity commission was needed not because there’s widespread corruption, but to give the public greater confidence.
“I think the public needs some assurance if something is there, if there is a suspicion, then there is a robust mechanism for dealing with it and investigating it,” Dr Thom told ....

New Mexico enacts landmark qualified immunity reform


Our nation is undergoing a crisis of confidence in law enforcement. Gallup reported last summer that, for the first time in the history of its polling, a majority of Americans do not have faith in the police. This plummeting confidence is fueled by the fact that police officers are rarely held accountable when they commit misconduct, and that lack of accountability is largely the product of qualified immunity a judicial doctrine that shields public officials from civil liability, even when they break the law.
But New Mexico took a huge step toward correcting this crisis this past Wednesday when Gov. Lujan Grisham signed into law HB 4, otherwise known as the New Mexico Civil Rights Act. This landmark piece of legislation permits citizens to sue any public official who violates their constitutional rights, and it specifically provides that qualified immunity is not a defense. ....
