Murder charges were dismissed against Marcus Roady

Murder charges have been dismissed against Marcus Roady according to a release from the Finney County Attorney s office.
Roady was arrested and charged in connection with the murder of Charles Ernie Ortiz on Sept. 23, 2019.
Circumstances at this time dictate the dismissal of current charges without prejudice, meaning Roady could be charged with the murder of Ortiz in the future should new or additional evidence come to light.
The Finney County Attorney’s office is responsible for upholding the law in the State of Kansas and holding individuals responsible for violations of those laws.
The investigation remains open and any information regarding the murder of Ortiz should be reported to the Garden City Police Department Investigations Unit. ....

Charge dismissed in Garden City restaurant owner's death

GARDEN CITY, Kan. (AP) Prosecutors have dismissed a murder charge in the shooting death of a Garden City restaurant owner but said the charge could be refiled if new evidence emerges.
Marcus Roady, 32, was charged in the death of Charles Ernie Ortiz, 69, the owner of the El Conquistador Restaurant in Garden City.
The Finney County attorney’s office said Thursday that current circumstances dictate dismissal of the charge but did not elaborate. The office said the case remains an open investigation, KAKE-TV reported.

Officers found Ortiz lying in the restaurant’s parking lot on Sept. 23, 2019. He was suffering from several gunshot wounds and was pronounced dead at a Garden City restaurant. ....
