The Retail Payment Activities Act: a step towards regulating payment service providers | Dentons


On April 30, 2021, the federal government introduced
An Act Respecting Retail Payment Activities (short title, 
Retail Payment Activities Act) (the “RPAA”). The much-anticipated RPAA comes in response to a consultation paper published by the Department of Finance in 2017, for a “New Retail Payments Oversight Framework” (the “2017 Consultation Paper”). We discuss the 2017 Consultation Paper
here. The RPAA signals the government’s continued willingness to regulate new and increasingly complex “retail payment activities” driven by innovative payment methods and technologies.
The RPAA will serve as the first regulatory regime for retail payment providers in Canada. Not surprisingly, it comes in the midst of a broader regulatory response by a government focused on protecting consumers, fostering competition and promoting innovation in the digital age.  Further evidence of this broader strategy can be observed in other recent legislative proposals ....

As the number of COVID-19 cases in Canada continues to surge, the push to vaccinate as many people as possible has intensified, but the cross-country rollout is still dealing with delays in the supply chain.
Last week Moderna was set to deliver 855,000 vaccine doses, which, as of Monday morning, had yet to arrive.
In an effort to reach out to the government to discuss the management of vaccine deliveries, the Massachusetts-based company has signed on with PAA Public Affairs Advisors, which has registered seven staffers to work on the file: Steve Van Groningen, Julie Groleau, Susan Cui, James Anderson, Felix Wong, Michael Von Herff and Noah Niznick. ....

Lobby Wrap: Paytechs of Canada seeking discussions to modernize payment systems

Paytech of Canada is is hoping to kickstart a conversation with the government about the modernization of the current payment system, as well as consumer privacy protections within the financial sector and end-user funds under the Retail Payments Oversight Framework.
The Canadian Payments Act sets out the legal framework for payments and gives oversight to the Minister of Finance.

Doug Kreviazuk has registered for the company for these discussions, Alex Vronces replaced Kreviazuk as executive director earlier this month. ....
