The Islamabad High Court (IHC) has noted that the PTI government still has 2 years to rule and its decision to introduce the electronic voting machines (EVMs) or to bring about changes in the High Education Commission (HEC) should be routed through the parliament rather than through ordinances.
“An ordinance can be passed only in an emergency situation when a law is needed to be imposed immediately and the parliament is not in session,” IHC Chief Justice Athar Minallah said on Wednesday as head of a division bench hearing a slew of petitions filed against PTI government’s ordinances. ....

OF late, there has been an uptick in the hearing of constitutional cases concerning the ordinance-making power of the president. Every now and then, ordinances enacted by the president are being challenged in Pakistan’s constitutional courts.
Two cases are worth mentioning. The federal government, through a notification dated March 26, 2021, announced the ‘removal’ of the chairperson of the Higher Education Commission Dr Tariq Banuri. This notification was challenged in the Sindh High Court, which stayed the appointment of a new chairperson. As Dr Banuri was removed pursuant to the Higher Education (Amendment) Ordinance, 2021, which reduced the tenure of the chairperson from four to two years, the government argued there were no ulterior motives behind his ‘removal’; rather, he ‘ceased to hold office’ by the operation of law. Similarly, MNA Mohsin Shahnawaz Ranjha challenged the legality of eight ordinances promulgated by the president in a single day (Oct 30, 20 ....

ISLAMABAD: Attorney General for Pakistan (AGP) Khalid Jawed Khan on Tuesday feared that the entire exercise of hearing the presidential reference on open ballot for coming Senate elections by the Supreme Court would turn academic if the proceedings were not closed by Wednesday (today).
Otherwise, the Election Commission of Pakistan (ECP) would not be left with ample time to complete the procedures that included printing of ballots for conducting the March 3 Senate elections, the AGP argued. ....
