20 Jul 2021 Conservative radio host Larry Elder filed a lawsuit Tuesday against California Secretary of State Shirley Weber over her decision to exclude him from the list of candidates for governor in the September recall of incumbent Gavin Newsom. As Breitbart News reported Sunday, Elder was excluded from the initial list of candidates, ostensibly because he filed incomplete tax returns (which he denies). Weber exempted Newsom from the same requirement, saying he is not a “candidate.” A statement Tuesday by the Elder campaign said: The secretary of state’s office has notified the Elder for Governor campaign that he did not qualify as a candidate due to redaction issues with the income tax returns filed with his candidacy application. No candidate has been previously disqualified for this reason. Elder filed suit today seeking an order from the Superior Court in Sacramento requiring Secretary Weber to list Elder as a candidate on the final certified list, to ....

Weber to protect his right to be a candidate in the special recall election scheduled for September 14, 2021.” The Elder for Governor campaign seeks the immediate legal relief of Elder’s name being added to the final recall candidate list in the 26-page suit, which contends: According to state law, Secretary Weber has the authority, if not the duty, to “fix” any redaction errors for the public. She did not. Instead, her office spent the past weekend talking to one reporter after another, rather than notifying Elder of its decision. It was not until Sunday evening that her office sent a formal notification to the Elder campaign. ....
Justin Sullivan/Getty Images 12 Jul 2021 A California judge has rejected incumbent Governor Gavin Newsom’s effort to correct an oversight in his filing papers and list himself as a Democrat in the Sep. 14 recall election, meaning that he will face the voters without a party label. As Breitbart News reported last month, Newsom asked Secretary of State Shirley Weber to grant him lenience after lawyers for the governor failed to list his party preference in responding to the recall, as required by California law. But Weber refused, so Newsom was required to go to court in an effort to be listed as a Democrat. Superior Court of Sacramento County Judge James P. Arguelles refused to allow Newsom to correct the error, noting that Weber did not have legal discretion to allow it. ....
