Daly relied on an Illinois appellate court decision from 1991, finding contractors owe a duty to persons they might reasonably expect to be in the vicinity. She found allegations of acts or omissions taken by defendants in relation to fall risks adequately addressed foreseeability and proximate cause. Davis died in pursuit of criminal suspects, in October 2018. Estate administrators Jacqueline Davis and Romero Davis sued project contractor KCI Construction in St. Clair County circuit court last October. ....

Ricardo Davis, Sr. BENTON – U.S. Magistrate Judge Reona Daly gave the estate of Washington Park auxiliary policeman Ricardo Davis 30 days to connect his death to a repair job on Poplar Street Bridge where he fell. Daly dismissed the estate’s complaint against KCI Construction, D and K Welding, and Thomas Industrial Coatings on Jan. 19, without prejudice. She found the bare allegations failed to satisfy the requirement of proximate cause necessary to sustain the claims. She set a Feb. 18 deadline for amendment. Davis jumped from the bridge on the Illinois side while chasing a suspect in 2018, expecting to land on bridge surface below. ....

According to the complaint, Washington Park auxiliary police officer Ricardo Davis, 44, was in a foot pursuit of a suspect in the line of duty at 3 p.m. on Oct. 27, 2018, when he allegedly fell through an opening on the bridge and fell. The fall caused his death, the suit states. KCI Construction filed a motion to dismiss the complaint for failure to state a claim on Nov. 25 through attorney David Berwin of Evans & Dixon LLC in St. Louis. ....
