The prosecutor in charge of seven of the eight cases flowing from the partial takedown of the Plaza obelisk on Indigenous Peoples Day wants to make sure everyone is on the same page.
Assistant District Attorney Richard Wilson has called a meeting with the lawyers representing the eight defendants in this rare situation. Kitren Fischer, who represents one of the accused, tells SFR she originally suggested the meeting to give everyone access to the same information.
There is no set date or time.
Of course, every case is different, but they re almost exactly the same, and so it s just rare that we do that, Wilson tells SFR. Traditionally I would call up the attorneys anyway to talk about the cases prior…I wanted to make sure that I wasn t telling everybody different things. Specifically, I m not going to lie, I kind of forget who I told stuff and who I haven t and so we just wanted to set up a meeting with all counsel on the case. ....

SANTA FE – The 1st Judicial District attorney says that the case of a Santa Fe man charged for his role in an Indigenous Peoples Day rally that turned destructive is essentially over, due to a Santa Fe police officer’s failure to meet court-ordered deadlines.
Santa Fe Magistrate Donita Sena ruled Monday that the prosecution can’t call witnesses in the case because an officer failed to provide a witness list on time. As a result, District Attorney Mary Carmack-Altwies said her office won’t be prosecuting the case. ....

Case against suspect involved in Santa Fe obelisk protest moves forward

ALBUQUERQUE, N.M. A case against a suspect involved in the Santa Fe obelisk incident will move forward after it was dismissed earlier this month due to a technical error. 
The case was previously dismissed after Santa Fe Police Officer Jesse Campbell failed to appear in court. 
On Monday, the court took some responsibility for that. 
“The court is sorry the case has created confusion due the inability to authenticate or verify that notice of motion was emailed to the prosecuting officer,” said Judge Donita Sena. 
Officer Campbell appeared in court Monday, and argued that the dozens of officers mentioned in his police records should be allowed to testify.  ....

SANTA FE – The case against a Santa Fe man involved in a demonstration that saw the city’s historic obelisk torn down in October is back on.
Magistrate Donita Sena, who dismissed the case last month because a Santa Fe police officer failed to show up for a motions hearing, agreed to reschedule that hearing after learning the court failed to give the officer proper notice of the hearing.
Sean Sunderland, 24, is charged with criminal trespass and resisting an officer, and is one of six people charged for their alleged part in the Indigenous Peoples Day demonstration on Oct. 12. The new date of the hearing is Jan. 25. ....

SANTA FE – Santa Fe police say the officer who failed to attend a court hearing for a man involved in a demonstration that saw a 152-year-old obelisk torn down in October never got notice of a hearing in the case last month.
As a result of the officer not showing up for the Dec. 28 hearing, a Santa Fe magistrate judge dismissed the case against 24-year-old Sean Sunderland, who had been charged with criminal trespass and resisting an officer.
In a late Tuesday afternoon news release, the Santa Fe Police Department said that the Magistrate Court manager failed to notify officer Jesse Campbell of the hearing, resulting in him not showing up. ....
