Saskatoon woman Tiara Jackle files statement of defence in response to civil suit by local band Bombargo

None of the statements in either filing have been tested in court.
The statement of claim was filed over statements made in a March 22 Facebook post by Jackle, as well as subsequent comments made on the original post.
The post outlined events Jackle said took place during filming of a promotional video organized by the all-male Saskatoon Yukigassen snowball team in February 2016; two members of the team are currently members of Bombargo. Jackle said she was one of three models all female present for the video shoot.
In the post, Jackle said there was a scene in which she was instructed to lead some team members into a private room with a “sexy smirk,” implying “that a sexual act would commence in the room between myself and the Yukigassen members.” Later in the shoot, one of the men grabbed her hips from behind, telling her “this angle captures your curves better,” she said in the post. ....

Her claim says she “verbally and physically resisted Mr. Skinnider’s actions, includ(ing) by repeatedly telling him ‘no,’ ” and that Skinnider did not wear a condom during the assault and stayed until the next morning.
His statement of defence says Skinnider denies making advances on Skjonsby, denies kissing her and denies making non-consensual physical contact. It says he admits returning to her apartment, and claims that the main entrance to the building was locked so he was only able to enter when she opened the door remotely.
“The Defendant states that he and the Plaintiff then engaged in consensual sexual intercourse and that at no time did the Plaintiff withdraw her consent, either expressly or implicitly,” it adds. ....
