The Madras High Court on Wednesday restrained the Land Acquisition Officer-cum-District Revenue Officer of Coimbatore South from proceeding with the acquisition of a small piece of 65.9 square metres of land belonging to a private advertising firm as part of a much larger acquisition planned for constructing a 10.10 km elevated highway on the Avinashi Road in Coimbatore city.
A Division Bench of Justices M. Sathyanarayanan and A.A. The Supreme Court will soon decide whether states can avoid using the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act of 2013 (or LARR) when acquiring private properties for public projects.
The Supreme Court case relates to an appeal filed by the Tamil Nadu government against a Madras high court order from July 2019. The high court had struck down an attempt by the Tamil Nadu government in 2014 to exempt the application of the LARR to three state laws that have provisions for the acquisition of land. These provisions are similar to the British-era Land Acquisition Act of 1894, which the LARR had repealed and replace ....

SC to hear challenge to T.N. Land Acquisition Laws Act on February 16


Petitioners should not be dispossessed of the land until further orders: Bench
The Supreme Court on Monday fixed February 16 for hearing agriculturists challenging the legality of the Tamil Nadu Land Acquisition Laws (Revival of Operation, Amendment and Validation) Act, 2019.
Meanwhile, a Bench, led by Justice A.M. Khanwilkar, said none of the petitioners should be “dispossessed of the land until further orders”.
The stay came on the strength of the arguments made by senior advocate P. Wilson, for the agriculturists, that they were farmers growing paddy on these lands.
The court made it clear that the case would not be adjourned on February 16 on any count. ....
