The Madras Bar Association has filed a writ petition in the Supreme Court challenging the
Sections 184 and 186 of the
Finance Act 2017 give Central Government rule-making power in relation to the mode of appointment, terms of service, allowances of members etc., of various Tribunals.
The Ordinance, promulgated by the President on April 5, follows the Rules made by the Centre in 2017 and 2020, which came under severe criticism from the Supreme Court. The 2017 Tribunal Rules were quashed by the Supreme Court in the 2019 case

New Delhi, Jan 7 : The Supreme Court on Thursday sought response from the Centre on the Jamiat Ulema-I-Hind s plea raising concerns over the arbitrary appointment of Chairperson and members of the National Commission for Minority Educational Institutions (NCMEI).
After a hearing in the matter, a bench comprising Justices L Nageswara Rao, Navin Sinha and Indu Malhotra issued notice.
Jamiat Ulema-I-Hind, in the plea filed through advocate Wajeeh Shafiq, argued that the Chairperson and the members have been appointed in an arbitrary manner without inviting applications by issuing advertisements. ....

New Delhi [India] January 8 (ANI): The Supreme Court on Thursday issued notice to the Centre on a plea seeking appointment in National Commission for Minority Educational Institutions (NCMEI) on the recommendation of a committee constituted by the Chief Justice of India till National Tribunal Commission is set up as per the direction of the top court.
A Bench headed by Justice L Nageswara Rao sought the response from the Centre on a plea filed by Jamiat Ulama-i-Hind.
The plea sought that appointments to the Commission be made on the basis of recommendations by a committee appointed by the Chief Justice of India till the National Tribunals Commission is formed. ....
