Court grants public access to report on Canaan police probe

Judge favors newspaper in Right to Know case


A Grafton County judge has ruled that a newspaper should have access to an internal affairs report into an excessive force complaint against a Canaan police officer, even when the report found in his favor.
In a Dec. 2 ruling, Superior Court Judge Peter Bornstein granted access to a report commissioned by Canaan police following complaints by a local woman charged with resisting arrest and disobeying a police officer.
The case involving former Officer Samuel Provenza is believed to be the first Right-to-Know case involving police files since last spring, when the New Hampshire Supreme Court overturned a 27-year-old precedent and granted access to public employee personnel files if a good reason exists to do so. ....

Judge to hear Right to Know case over police certification


A judge has scheduled a hearing for next month that could decide whether a state board must provide access to meetings and records involving the certification of New Hampshire police officers.
The Merrimack County Superior Court hearing is on a case filed by the Union Leader Corp. after the New Hampshire Police Standards and Training Council closed a discipline-related certification hearing in October.
The hearings addressed the certification of Loudon police officer Justin Swift, who was fired from his previous employer, the Ossipee Police Department.
While dozens of state boards hold open hearings for licensing and certification of professions ranging from nursing to home inspection, law enforcement certification hearings are closed. ....
