Water Quality Standards and Natural Gas Pipelines
SB 1311 (McClellan) requires an applicant for a natural gas transmission pipeline greater than 36 inches (inside diameter) to submit in its application a detailed erosion and sediment control plan and stormwater management plan (Plan) subject to Department of Environmental Quality (DEQ) review and approval. Upon receipt of such application, the bill directs DEQ to issue a request for information from the applicant about how the Plan will address activities in or related to upland areas. DEQ must consider such information in developing a draft certification or denial, and in issuing additional notice to the public. SB 1311 also prohibits DEQ and/or the State Water Control Board from expressly waiving certification of a natural gas transmission pipeline of greater than 36 inches inside diameter under § 401 of the federal Clean Water Act and requires a decision on a certification request within a reasonable time pursuant to feder ....

Solid Waste/Stormwater Enforcement: Arkansas Department of Energy and Environment - Division of Environmental Quality and Little River County Solid Waste Transfer Station Enter into Consent Administrative Order | Mitchell, Williams, Selig, Gates & Woodyard, P.L.L.C.


The Arkansas Department of Energy and Environment – Division of Environmental Quality (“DEQ”) and Little River County (“Little River”) entered into a February 3rd Consent Administrative Order (“CAO”) addressing alleged violations of the Arkansas Solid Waste Management Code (Arkansas Pollution Control and Ecology [APC&EC] Regulation 22) and a Stormwater Clean Water Act National Pollution Discharge Elimination System (“NPDES”) permit. The CAO provides that Little River operates a solid waste transfer station (“Facility”) located in Ashdown, Arkansas.
The Facility is stated to have held a solid waste permit from August 17, 2007, to May 23, 2011.
A DEQ solid waste inspector is stated to have conducted a routine inspection at the Facility on November 27, 2018. The following violations of Arkansas Pollution Control and Ecology Commission (“APC&EC”) Regulation 22 were allegedly identified: ....

The Arkansas Department of Energy and Environment – Division of Environmental Quality (“DEQ”) and USA Truck, Inc. (“USA”) entered into a November 24th Consent Administrative Order (“CAO”) addressing alleged violation of an Industrial Stormwater General Permit (“Stormwater Permit”). See LIS No. 20-190.
The CAO provides that USA operates transportation and logistics facilities in Crittenden County (“Crittenden County Facility”) and Crawford County (“Crawford County Facility”).
Both the Crawford County Facility and Crittenden County Facility are regulated pursuant to the Clean Water Act for stormwater discharges.
DEQ is stated to have issued Stormwater Permit coverage to USA for discharge of stormwater into waters of the state with an expiration date of June 30, 2019, to both the Crawford County Facility and Crittenden County Facility.
