NWRA Says EPA's Emission Rules for Landfills Brings Certainty

Arlington, VA – The Environmental Protection Agency (EPA) published its Federal Plan for Municipal Solid Waste Landfills on May 21 and becomes effective on June 21. The federal plan implements the emission guidelines (EG) and compliance times for municipal solid waste (MSW) landfills (2016 MSW Landfills EG) for existing MSW landfills located where state plans are not in effect.
“We are pleased that the EPA has issued the federal plan,” said NWRA President and CEO Darrell Smith. “It provides more regulatory certainty for our industry.”
The federal plan includes: identification of legal authority and mechanisms for implementation; inventory of designated facilities; emissions inventory; emission limits; compliance schedules; a process for the EPA or state review of design plans for site-specific gas collection and control systems; testing, monitoring, reporting and recordkeeping requirements; and public hea ....

Biden administration to review contentious EPA landfill emissions regulation

UPDATE: March 8, 2021: The U.S. EPA has asked a court to vacate the rule meant to delay implementation of 2016 landfill methane emission guidelines and send it back to the agency to review. The agency filed an unopposed motion in the U.S. Court of Appeals for the D.C. Circuit on March 4, saying it would issue a federal plan by May 2021 for any state that does not have an approved plan for implementing the regulation.
The EPA argued vacating the case would not cause “deleterious effects on public health and the environment” because it would not affect the timeline for establishing the federal plan by that date. The EPA under the Trump administration proposed a federal plan in August 2019, giving itself two years to promulgate necessary state plans. ....

Yesterday was also an important day for Mother Nature and the nation. The US Court of Appeals for the District of Columbia Circuit unanimously tossed the Trump administration s replacement for Obama s Clean Power Plan (CPP) back to EPA. The Agency will now be coming out with some version of the CPP.
Look for my continuing comments on these and other Biden administration efforts to put the nation s economy on a low-carbon trajectory.

Coal ash. Itâs a burden that has been decades in the making, but has only recently been dealt with by the utility plants it has fueled.
Now some local residents are worried that it might end up in a landfill near them, even though the landfillâs developers have repeatedly said they would not accept coal ash.
Solid Solutions Development, the company proposing the Haralson County landfill, has said that it will not accept out-of-state waste in general and will not accept coal ash or sewer sludge at all.
Those conditions will be written into the agreement with the community, said Tee Stribling, one of the founders of the firm. That cannot be changed, he said. It will be written into the application for the permit and it will be written into the zoning. ....
