FDA Waiving Surprise Fees On Distilleries Producing Sanitizer

The Department of Health and Human Services has ordered the Food and Drug Administration to stop enforcement of an arbitrary fee the FDA was trying to impose on distilleries in Kentucky and other states.
The FDA was attempting to assess a $14,000 fee on distilleries such as Casey Jones and others who stepped up to produce hand sanitizer during the COVID-19 pandemic.
The Department of Health and Human Services Chief of Staff Brian Harrison announced on December 31 they directed the FDA to cease enforcement of the arbitrary, surprise fees. Harrison said in a statement on Twitter Thursday Small Businesses who stepped up to fight COVID-19 should be applauded by their government, not taxed for doing so. ....

Local Distillery Hammered by Fee For Making Hand Sanitizer

Casey Jones produces 7,500 gallons of moonshine and 5,000 gallons of bourbon every year while employing only eight people. In a year that has been hard on nearly everyone, a fee of this magnitude could be detrimental. Especially if it happens twice. Hays cannot sell a bottle after Thursday without incurring another fee assessment.
The problem is that a provision in the CARES Act reclassified distilleries that make hand sanitizers as drug manufacturers, allowing the FDA to treat them as such with fee assessments.
Hays provided the News Edge with an FDA document outlining the fee rates for the over-the-counter monograph drug user fee program for fiscal year 2021. ....
