Back Forty mine dealt blow as Michigan judge stalls decision on permit


A proposed mine along the Menominee River in Michigan is facing another roadblock after a judge asked that a decision to approve a necessary permit be revisited. 
A Michigan Circuit Court judge last month asked that a 2019 decision to approve a mining permit for Aquila Resources should be revisited, according to nonprofit environmental law firm Earthjustice. In the order, the judge directed that additional evidence was needed in the original permit application, including documented concerns from Michigan environmental regulators regarding flawed groundwater modeling. 
The judge also said that the company failed to provide a complete assessment of potential alternatives to the proposed plan because several of the alternatives offered, such as an underground mine, did not include costs for operation.  ....

Menominee Indian Tribe of Wisconsin Prevails in Another Legal Victory Against Back Forty Mine

A recent Court decision has created even more uncertainty about the fate of the Back Forty mine, a proposed open-pit mine on the border of Michigan and Wisconsin that has prompted strong opposition from the Menominee Indian Tribe of Wisconsin because it would release toxic pollution into the Tribe’s namesake river and threaten a landscape of historic and cultural resources including dance rings, raised gardens, and burial mounds.
On April 23, a Michigan Circuit Court judge ordered an Administrative Law Judge (ALJ) to reconsider his 2019 decision approving a mining permit for Aquila Resources’ Back Forty Project. In this order, the judge remanded the mining permit decision for reconsideration, directing that the ALJ admit additional evidence including documented concerns from Michigan environmental regulators regarding flawed groundwater modeling. BISMARCK – It was a year to be remembered. When Gov. Doug Burgum delivers his State of the State Address to the Legislature on Tuesday, he will have much to reflect on.
“The historic health and economic challenges of the past year remind us of North Dakotans’ strength, resiliency and ability to overcome adversity.
