Inmarsat wins against Dutch government over 5G spectrum allocation A court in the Netherlands has ruled in Inmarsat’s favour in a case brought by the satellite communications company against the Dutch government, it’s been announced. The case involved the provision of satellite safety services from the UK company’s ground station in Borum in Friesland, in the north of the Netherlands. The Administrative Court has now ruled to suspend the Dutch Government’s update to the National Frequency Plan that reallocated spectrum used by Inmarsat’s C-band (3.5GHz) for essential safety and distress services to 5G telecoms from 1 September 2022. The court has also recommended that the Dutch Government hold talks to find a solution or risk the full court proceedings annulling the National Frequency Plan altogether. ....

The European Court of Justice (ECJ) in France The Court of Justice of the European Union (EU) issued a ruling Thursday that rejected a challenge by Eutelsat and Inmarsat’s European Aviation Network (EAN). Arcep gave Inmarsat and its operating partner Deutsche Telekom access to frequencies and permission to operate complementary ground components for an in-flight connectivity service over France in 2018. Shortly after, Eutelsat and Viasat filed a challenge with France’s Conseil d’État (Council of State) claiming that Inmarsat was using the mobile satellite spectrum it was granted for services that were more attuned to cellular service.
