'Cautiously optimistic': Experts respond to NSW consent law reform

Attorney-General Mark Speakman announced yesterday that he’d seek to reform NSW consent laws to include “enthusiastic” or “affirmative” consent.
The announcement was met with widespread praise by survivors like Saxon Mullins who told
SBS News the proposed changes were an important step into changing the way that we talk about sexual violence.”
But two experts told
The Feed that while they welcome the proposed changes, they remain ‘cautiously optimistic’ about how they’d work in practice.

Dr Julia Quilter has already examined the three major legislative reforms in the sexual offences space; in 1981, 1989 and 2007.
She said while the reforms proposed by the Attorney-General have the potential to create positive change, we won’t know their impact until they’re tested in courtrooms. ....

A barrister who owed the Australian Taxation Office in excess of $550,000 has failed to have orders removing his name set aside but was permitted a downgraded finding from professional misconduct to unsatisfactory professional conduct after the Civil and Administrative Tribunal failed to take into account mitigating circumstances. 
As a result of action taken by the Australian Taxation Office (ATO), a barrister based in NSW was ordered to meet certain tax reporting and payment conditions but failed to regularly and satisfactorily do so. As a result, the state’s Bar Council pursued discipline hearings and was successful in having his name removed from the roll.  ....

Decades of reports on over-representation of First Nations peoples in custody must not be ignored

New South Wales Bar Association President, Michael McHugh SC, described the report today as an “important piece of work that stands on the shoulders on 30 years’ worth of like inquiries”.
“It beggars belief that on the 30
th anniversary of the Report of the Royal Commission into Aboriginal Deaths in Custody, recommendations from that landmark report are still to be implemented. This cannot be acceptable and should not be tolerated,” Mr McHugh SC said.
“The over-representation of First Nations peoples in NSW is nothing short of a state crisis.
“Despite a number of reports and inquiries over some decades, First Nations people remain significantly and unacceptably over-represented in NSW prisons and the criminal justice system. While First Nations people represent 3% of the population in NSW, they represent 40% of adults refused bail in NSW and 25% of the prison population. ....
