Reforming the law is necessary to account for the reporting of historical child sexual abuse
Over the last nine years, India has sought to “protect children from offences of sexual assault, sexual harassment and pornography” through the Protection of Children from Sexual Offences Act (POCSO). But POCSO has not been without controversy or deficiency. Recently, the Supreme Court had to injunct an interpretation of ‘skin-to-skin contact’ given by the Bombay High Court. Another fundamental defect of POCSO is its inability to deal with historical cases. With growing international jurisprudence around these issues, and in line with the UN Convention on the Rights of the Child, India must revise its legal and procedural methods to deal with historical child sexual abuse. ....

The Assam unit of Congress has resented the posting of an IPS officer charge-sheeted for sexually assaulting a minor as the Superintendent of Police of a district in Bodoland Territorial Council.
The 2012 batch IPS officer from Uttar Pradesh was posted on May 14, almost two months after a special judge for the Protection of Children from Sexual Offences (POCSO) Act filed a charge sheet against him for allegedly sexually assaulting the 14-year-old daughter of a senior police officer in December 2019. ....

Guwahati: After messaging a friend that she had been sexually assaulted, a 14-year-old girl allegedly killed herself in a college teacher’s home in Assam’s Chirang district, the police said on Tuesday.
She had been staying at the teacher’s house for approximately a year with the purpose of studying. He was an assistant professor at a college in Bengtol, and was arrested on the charge of rape and abetment to suicide. ....

Punishing an adolescent boy who enters into a relationship with a minor girl by treating him as an offender was never the objective of the POCSO Act, Justice N Anand Venkatesh said.

Chennai: The Madras High Court has said the POCSO Act does not intend to punish an adolescent boy for entering into a relationship with a minor girl and batted for parental and societal support for the couple in the grips of biological changes.
Justice N Anand Venkatesh observed that while the Act was brought in to protect children from sexual offences, a large array of cases were arising on the basis of complaints being filed by families of adolescents and teenagers involved in romantic relationships. ....
