New Bedford clam bar can't reopen yet, under state review

NEW BEDFORD Last summer, you may have walked down to Pier 3, picked up a lobster roll or clam cakes from the city s new clam bar, The Whale s Tail, and enjoyed your meal while watching commercial fishing vessels maneuver around the port.
Whether that can happen again is up to the Massachusetts Department of Environmental Protection. The agency is currently reviewing the New Bedford Port Authority s application to change the authorized use of the 208-square-foot shed in which the clam bar sits from water-dependent, industrial use to restaurant use.
Edmund Coletta, press secretary for MassDEP, said in an email that the use of the shed for a restaurant has not been authorized and will not be authorized unless and until a license has been issued. Last summer, the clam bar operated without the necessary state authorization. ....

Nearly four years after a development team first submitted a letter of intent to construct a complex of buildings on the Port Norfolk waterfront, they may finally be moving ahead with community approval.
On March 30, the BPDA hosted a public meeting on a new and updated proposal for the 24 Ericsson Street site. Over an hour-long presentation, the development team, including Jeremy Henry of RISE Together, Kevin Deabler of RODE Architects, and David Black and Stephanie Kruel of VHB Inc., laid forth a revised proposal for the site that emphasized public access to the Port Norfolk waterfront, neighborhood cohesion, and climate resilience. Katharine Armstrong, et al. v. Kathleen Theoharides, et al.,
[1] which impacts coastal properties on previously filled tidelands and millions of square feet of buildings throughout the Commonwealth that were constructed, purchased, and financed in reliance on Chapter 91 licenses issued in conformance with municipal harbor plans. Absent the decision being overturned or legislative action to authorize the longstanding regulatory process for approval of municipal harbor plans, the Court’s decision creates significant uncertainty both for those properties already licensed pursuant to a municipal harbor plan and for those that are in the midst of their design and permitting processes. ....
