Mashpee Wampanoag Tribe Elections Set For Sunday


Now that the Mashpee town election is over and done with, a segment of the town—members of the Mashpee Wampanoag Tribe—will now turn its attention to the tribe’s election. Voting for the tribal election is set for Sunday, May 16.
The election will reshape the tribal leadership just months after the former chairman of the tribal council, Cedric Cromwell, was removed from his post after being indicted on federal charges for his alleged role in a bribery scheme involving plans to build a casino in Taunton.
The candidates in the four-way race for the chairman position include Aaron Tobey, Brian Weeden, Nelson Andrews Jr. and Kyle Bassett. Profiles of the candidates for the chairman position can be found on the Enterprise website. ....

Mashpee Wampanoag Tribal District Court Sees Problem With Upcoming Election

The Mashpee Wampanoag Tribal District Court is ruling that there is a problem with the upcoming tribal election.
A lawsuit was filed over an election ordinance which suspended in-person voting and required vote-by-mail for the March 26th election because of the pandemic.
A judge decided last week that the ordinance violates the tribal constitution.
A meeting was set for this morning to determine the next course of action.

Mashpee Wampanoag Tribal Court Rules Mail-In Voting Unconstitutional


The Mashpee Wampanoag Tribal District Court ruled on Thursday last week, March 11, that the mail-in voting election procedures put in place for the tribal elections scheduled for later this month violate the tribe’s constitution.
The lawsuit by Aaron Tobey Jr., who is a tribal council member and candidate in the four-way race for the position of chairman of the tribal council, disputed the constitutionality of an emergency tribal ordinance passed earlier this year. The emergency ordinance cited the COVID-19 pandemic and scheduled the election for March 26 with mail-in voting only.
“The election as currently contemplated will violate the constitution,” said Alternate District Court Judge Amanda L. WhiteEagle. ....

Mashpee Wampanoag members sue to block mail ballots in tribal election


MASHPEE With the Mashpee Wampanoag Tribe’s general election only a few weeks away, a few members have raised concerns about the decision to hold the election exclusively through mail-in voting. 
Tribal members Aaron Tobey Jr., Crystal Asiwe and Steve Helme are suing members of the Mashpee Wampanoag Tribal Council and the Mashpee Wampanoag Tribe Election Committee at the tribal court, arguing that holding the March 26 election through mail-in voting is against the tribe’s constitution. 
“What my client is arguing, is that the constitution really prescribes the election process for the tribe,” attorney Jonathan Polloni, representing the plaintiffs, said in a phone interview, “and what’s happened is that the tribal council has really buried that process. That is significant and deserves a lot of caution.”   ....
