LOS ANGELES (CNS) - A judge today rejected a bid for re-sentencing by a Palmdale woman who pleaded guilty to the first-degree murder of her 8-year-old son, who was routinely beaten, starved, forced to sleep in a closet and tortured until his death eight years ago.
Pearl Fernandez, now 37, was sentenced in March 2018 to life in prison without the possibility of parole for the May 2013 killing of her son, Gabriel, but contended in an April 1 petition that she could not now be convicted of first-degree murder or second-degree murder because of recent changes made in state law that affect defendants in some murder cases. ....

LOS ANGELES - A Palmdale mother convicted of torturing and murdering her 8-year-old son, Gabriel Fernandez, has filed a petition to have her murder conviction vacated and be resentenced.
Pearl Fernandez, now 37, filed a petition under California s Penal Code 1170.95. She is currently serving a life sentence without the possibility of parole.
A hearing on the petition for re-sentencing is set for June 1 before Los Angeles Superior Court Judge George G. Lomeli.
Penal Code 1170.95 allows those convicted of murder under a natural and probable consequences theory to file for resentencing. In her petition, Fernandez declares changes made to Penal Codes 188/189 in 2019, which alter how malice is imputed on someone, that would possibly alter her murder conviction. ....

Families now have to relive all the horror that was perpetrated upon a small and helpless child. Based upon all the evidence presented at the grand jury, which was made public, and the jury trial, Pearl Fernandez was a major participant in the torture and murder of little Gabriel. The evidence clearly showed that Pearl Fernandez physically assaulted, abused, tortured and starved Gabriel over an eight-month span which lead to his death. ....
