Barrington doctor appeals his conviction in assault on neighbor

PROVIDENCE The Barrington doctor found guilty of assaulting his neighbor in a racist tirade that sparked protests has appealed his conviction to Superior Court.
Judge Stephen Isherwood last month found Dr. Richard Gordon, 71, guilty of simple assault and disorderly conduct in the Aug. 3 confrontation with his neighbor, Bahram Pahlavi, over a boundary dispute.
Isherwood, however, declined to sentence Gordon under the Rhode Island Hate Crimes Sentencing Act, as sought by Attorney General Peter F. Neronha s office. The judge s decision that spared Gordon from serving at least 30 days and up to a year in prison upon conviction. Isherwood concluded that the state had not proven beyond a reasonable doubt that Gordon’s crimes were racially motivated. ....

PROVIDENCE It was an invective-laced attack that sparked condemnation and protests at a time of racial reckoning, but a judge on Tuesday nonetheless cleared a Barrington doctor of allegations he assaulted his neighbor out of hatred for the man’s Iranian heritage and Muslim faith.
Judge Stephen Isherwood declined to sentence Dr. Richard Gordon, 71, under the Rhode Island Hate Crimes Sentencing Act, a decision that spared Gordon from receiving at least 30 days and up to a year in prison. Barrington man found guilty of simple assault, disorderly conduct against neighbor

PROVIDENCE, R.I. (WLNE) – A Barrington man was found guilty on misdemeanor assault and disorderly conduct charges after an altercation with his next-door neighbor in August.
Richard Gordon, 71, was found guilty in court on Wednesday of one count of each simple assault and disorderly conduct.
“The State filed a sentencing enhancement in this case, pursuant to Rhode Island’s Hate Crimes Sentencing Act, on August 11, 2020. In Rhode Island, there is no free-standing hate crime; rather, a defendant must first be convicted of a criminal offense,” a release from the attorney general’s office stated.
“If a defendant is convicted of a criminal offense, there is a separate sentencing hearing at which the State must prove that the criminal offense was motivated by ‘the actor’s hatred or animus toward the actual or perceived disability, religion, color, race, national origin or ancestry, sexual orientation, or gender of that person.’� ....
