The Missouri DNR is now considering an updated five-year operating permit for the Labadie Energy Center, the state s largest coal-fired power plant.
A coalition of Franklin County residents and environmental groups wants Missouri officials to tighten permitting restrictions on the state’s largest coal-fired power plant.
Environmental advocates say wastewater used for cooling Ameren’s Labadie Energy Center, along with toxic contaminants leaching from coal ash ponds, pose a risk to wildlife and the surrounding area. As state officials prepare to renew the power plant’s operating permit for another five years, opponents maintain the proposed draft violates federal law and must be rewritten. ....

On February 11, three environmental groups Sierra Club, Alliance for Affordable Energy, and PennEnvironment, Inc. filed a petition for review in the D.C. Circuit Court of Appeals (D.C. Circuit) challenging the U.S. Environmental Protection Agency’s (EPA) recent final rule titled, “Hazardous and Solid Waste Management System: Disposal of CCR; A Holistic Approach to Closure Part B: Alternate Demonstration for Unlined Surface Impoundments,” 85 Fed. Reg. 72,506 (Nov. 12, 2020). Commonly called “Part B,” the rule allows owners and operators to submit demonstrations showing their clay-lined impoundments are adequately protective of human health and the environment. Part B is the second of two rulemakings comprising EPA’s “Holistic Approach to Closure” amendments to the coal combustion residuals (CCR) rule. Groups challenge rollback of coal ash rule

A coalition of environmental groups challenged the U.S. Environmental Protection Agency s rollback of a rule that will delay the closure of some coal ash ponds.
Earthjustice lawyers representing the organizations said many of the utilities seeking exemptions allowed by the revised rule would be in the process of closing the impoundments. They said the rollback of the 2015 Coal Combustion Residual Rule provides exemptions and loopholes that could delay closure of some ash ponds until 2038. 
EPA Administrator Andrew Wheeler said in July the rollback would give electric utilities enough time to retrofit or replace unlined impoundment ponds. The 2015 rule required utilities to cease dumping coal ash and initiate closure of all impoundments by April 2019.  ....
