Del Mar lifeguard's wrongful termination lawsuit dismissed

Two of the claims filed against the city of Del Mar by former head lifeguard Pat Vergne have been dismissed, City Attorney Leslie Devaney said this week.
A judge dismissed the former employee’s allegations of defamation and wrongful termination and awarded the city $9,670.50 in legal fees, Devaney said after the City Council’s closed session discussion of the case on Monday.
An Aug. 31 conference has been scheduled to discuss the remaining matters in the case, she said.
Vergne’s attorney, Michael Lewis of the Los Angeles firm Engstrom, Lipscomb & Lack, said Thursday that he and his client had no comment on the case. ....

The Winston School and the city of Del Mar, which serves as landlord of the school property, continue to work toward an April deadline to finalize a development application.
Representatives from The Winston School, which serves a little more than 100 students in grades 6 to 12, met with city leaders this week and had “a very productive meeting following the June 2020 submission of our School Redevelopment Plan,” according to a statement from the school.
“I believe that we can move this process forward and work together to complete and meet not only the city’s vision and goals, but the school’s,” Dena Harris, Winston School’s head of school, said during public comment at the March 1 City Council meeting. ....

DEL MAR The Del Mar City Council is hoping to avoid a special election regarding a citizen-led effort to repeal a zoning ordinance by negotiating with proponents of the referendum.
Ordinance 973 changed zoning restrictions and established 20 dwelling units per acre in the city’s North Commercial Zone on Jimmy Durante Boulevard at San Dieguito Drive to create more housing density to complete the city’s latest Housing Element.
In a letter to the Department of Housing and Community Development (HCD) sent in October last year, the ordinance was described as a “crucial” part of the city’s efforts to finalize its obligations of the 6th Cycle Regional Housing Needs Assessment (RHNA) allocation for the 2021-2029 planning period prior to its April 15 deadline. HCD had agreed to accept the city’s response. ....

After a series of closed session meetings over the past few weeks, the Del Mar City Council unanimously voted Feb. 16 to terminate City Manager Christa L. (“CJ”) Johnson, who held the position for about a year.

The city announced two weeks ago, Friday, Feb. 5, that Johnson had been placed on paid administrative leave. Administrative Services Director Ashley Jones is now the interim city manager.
No information was publicly released about the reasons for the decision. But because Johnson was terminated with no cause, she will receive a lump sum payment equal to six months of her $240,000 annual salary as well as six more months of health benefits, based on the terms of her contract. ....
